Platform Fair Use Policy

This policy governs your use of the GavelGrow marketing platform at app.gavelgrow.com. It is incorporated by reference into our Terms of Service and applies to all Platform subscribers — Solo, Growth, Scale, and Enterprise tiers. Effective April 17, 2026 (version 1.0). Where this policy conflicts with the Terms, the Terms control.

One Human Per Seat

Each seat is a license for a single identified human. By using the Platform you agree:

GavelGrow audits compliance via login patterns, IP variance, and simultaneous-session detection. On violation we notify the Account Owner and request remediation, may automatically provision additional seats at the overage rate, and for repeated or willful violations may suspend the account pending review.

Overage charges are added automatically to the next invoice (shown before confirm). Hard cap reached = upgrade required (non-negotiable for Solo / Growth / Scale).

Bulk-Invite Protection

To protect against credential stuffing and automated abuse, the platform limits seat additions to 5 per rolling 24-hour period on Solo / Growth / Scale. Exceeding the rate triggers a block, an email to the Account Owner to confirm activity within 7 days, and manual review. Two flags within 90 days may trigger additional verification. Enterprise accounts with documented Customer Success rollouts are exempt.

SMS Usage Limits

Included SMS per tier — Solo 250/month, Growth 1,000/month, Scale 3,000/month, Enterprise 10,000+/month (contract-defined). Overage is $15 per 500-message block, auto-provisioned at 95% of allocation.

Per-hour outbound rate limits — Solo 50/hour, Growth 200/hour, Scale 500/hour, Enterprise 2,000/hour (configurable). Messages above the limit are queued server-side and released in the next window.

TCPA and Legal Compliance — Your Responsibility

You are solely responsible for compliance with TCPA, CAN-SPAM, and state attorney advertising rules — including prior express written consent before non-transactional SMS, consent records maintained 4+ years, honoring STOP / UNSUBSCRIBE / CANCEL / QUIT immediately, respecting quiet hours (before 8am or after 9pm recipient local time), including identification and opt-out instructions in messages, and using only approved 10DLC-registered campaigns.

The platform provides consent tracking, auto-STOP handling, quiet-hour enforcement, and audit logs — but this does not constitute legal advice and does not transfer compliance liability to GavelGrow. Violations result in immediate suspension.

Call Tracking Usage Limits

Included tracking numbers — Solo 1, Growth 3, Scale 10, Enterprise unlimited (contract-defined). Additional numbers $10/month each on any tier.

Prohibited uses include robocalling (automated outbound voice campaigns without consent), telemarketing to Do-Not-Call registry numbers, recording without proper two-party disclosure (jurisdiction-dependent), and any violation of the Twilio Acceptable Use Policy.

Data, Storage, and Compute

No hard caps on leads, cases, or storage on Growth, Scale, and Enterprise. Solo is capped at 500 leads/month and 50 active cases.

Abuse handling is reviewed individually: more than 500GB of call recordings or attachments → archive or purchase Enterprise storage add-on; more than 10M API requests/month (unusual for firm size) → migrate to metered Enterprise; crypto mining, third-party workload hosting, or non-GavelGrow use → immediate termination. The Account Owner is contacted before action in all routine cases.

Platform Integrity

You agree not to reverse-engineer, decompile, or disassemble the Platform or its infrastructure, scrape benchmark or aggregate data beyond reasonable personal use, circumvent rate limits, seat caps, feature gates, or billing meters, resell or redistribute Platform access (except via the Enterprise White-Label Add-On), or use the Platform to build a competing service. Violations result in immediate termination without refund.

Enforcement Philosophy

Changes to This Policy

Material changes (seat caps, rate limits, pricing) are announced by email to the Account Owner 30+ days before effective date, dashboard banner for 30 days prior, and changelog at gavelgrow.com/pricing. Existing subscribers are guaranteed current pricing for 12 months from the effective date of any price change, then may migrate or cancel without penalty.
